2. Application of These Terms

These Terms apply to purchases from our website and use of our website, together with the product descriptions, order details, Shipping Policy, Return and Refund Policy, and Privacy Policy applicable to your transaction.

Nothing in these Terms excludes, restricts, or replaces rights or remedies that cannot lawfully be excluded under applicable consumer protection or other laws. If a term conflicts with a mandatory legal requirement, that requirement prevails.

Customers must have the legal capacity to enter into a purchase agreement.

3. Product Descriptions & Handcrafted Variations

We aim to describe and photograph our products accurately.

Our products are handcrafted. Natural differences in wood grain, knots, texture, stain absorption, and hand-painted details may occur. Screen settings and lighting can also affect how colours appear.

These variations are part of handcrafted woodwork when consistent with the product description and any approved specifications. They do not excuse defects, damage, material inaccuracies, or failure to meet agreed specifications.

Dimensions are provided in the product listing or written quotation. If a precise fit is essential, tell us before ordering so any required measurements and tolerances can be agreed in writing.

4. Fireplace Mantel Construction & Installation

Our standard pine mantels are constructed from 3/4-inch solid Nova Scotia pine boards with a hollow interior, creating a beam-style appearance. The standard profile is 7 inches high by 7 inches deep, unless otherwise stated.

Custom dimensions and hardwood mantels are available by request. Construction, finish, mounting arrangements, price, and estimated delivery will be confirmed for the specific order.

Wood is combustible. Stain and clearcoat do not make a mantel heatproof.

Before purchasing or installing, confirm that the dimensions and intended placement comply with the fireplace manufacturer’s instructions and applicable building requirements.

Mounting must suit the mantel, wall structure, fasteners, and intended load. Do not assume a load capacity unless we have expressly confirmed it for your installation. Obtain qualified installation assistance where necessary.

We are not responsible, to the extent permitted by law, for damage caused by improper installation, misuse, unauthorized alterations, or failure to follow supplied instructions. This does not exclude responsibility for our own defective products or services.

5. Custom & Personalized Orders

Before production, we may ask you to approve dimensions, spelling, artwork, logo placement, materials, and finish.

Review these details carefully. We will manufacture to the approved specifications. Changes requested after approval may affect price and delivery time and require our written agreement.

If we reproduce customer-approved spelling or artwork accurately, a later preference change is not a manufacturing defect. Errors made by us remain our responsibility.

Custom quotations will identify payment requirements, any deposit, and cancellation conditions before you commit. No blanket non-refundable deposit condition is created by these Terms.

Custom and personalized products are final sale for change-of-mind purposes only where that condition was clearly disclosed before purchase.

6. Customer-Supplied Artwork

If you provide a logo, photograph, design, or other artwork, you confirm that you have permission to authorize its use for your order.

We may decline material that we reasonably believe infringes another person’s rights or is unlawful.

Supplying artwork for production does not give us permission to publish confidential designs, personal information, or your branding for marketing without separate permission.

7. Prices, Payments & Order Confirmation

Prices are in Canadian dollars unless expressly stated otherwise. Applicable taxes and shipping charges are disclosed before purchase.

Provide accurate billing, contact, and delivery information and use an authorized payment method.

We will provide an order confirmation containing the applicable purchase details. Please contact us promptly if anything is incorrect.

Price changes apply to future purchases and do not automatically change an existing order.

If we identify a material pricing or description error affecting your order, we will contact you to explain the issue and seek agreement on a correction or cancellation, as permitted by law. We will not impose an additional charge without your agreement.

If we cannot fulfil an order, we will notify you and refund payments for the unfulfilled portion as required by law.

8. Production, Shipping & Delivery

We ship within Canada. Available shipping services and charges are shown at checkout or confirmed in your quotation.

Production time and carrier transit time are separate. Applicable production and delivery estimates will be disclosed in the listing, checkout, or written order agreement.

Contact us before ordering if you require delivery for a particular date.

If a delay occurs, we will communicate revised information. References to estimated dates or carrier delays do not remove any statutory cancellation or refund rights.

Additional shipping charges for oversized or custom orders must be disclosed and agreed before they are charged.

9. Address Errors & Delivery Problems

Check your shipping address before placing your order. Notify us promptly of any correction.

Where permitted by law, reasonable additional carrier costs caused by customer-supplied address errors, unclaimed shipments, or unjustified refusal of delivery may be charged to the customer. We will explain those costs.

This does not apply where the problem resulted from our error or where the customer is exercising a legal cancellation or other remedy.

A tracking scan alone does not automatically resolve a disputed delivery. Contact us if your shipment is missing so we can investigate.

10. Shipping Damage & Carrier Claims

Shipping damage to products, including fireplace mantels and triple birdhouses, will be investigated through the carrier’s damage-claim process.

Contact us promptly at atlantic@woodnwares.ca with your order number and photographs of the item, shipping label, outer packaging, and internal packing materials.

Keep the item and packaging where reasonably possible, as the carrier may require an inspection. Contact us before returning or disposing of the shipment.

We will coordinate or assist with the claim according to the carrier’s requirements.

The customer’s payment of shipping charges does not, by itself, transfer all transit risk or responsibility to the customer. Carrier claim approval, insurance limits, or carrier reimbursement do not limit remedies we are legally required to provide.

We will arrange an appropriate resolution according to the circumstances and applicable law.

11. Returns, Final-Sale Products & Restocking Fees

Our Return and Refund Policy explains the process for eligible returns.

Fireplace mantels and triple birdhouses are final sale for change-of-mind returns and exchanges, including standard and custom orders. This condition must also be disclosed before purchase.

Other eligible change-of-mind return requests must be made within 30 days of delivery. Items must be unused, in their original condition and packaging, with proof of purchase.

Customers must contact us for return instructions before shipping an item back.

For approved change-of-mind returns:

• The customer pays return shipping.

• Original shipping charges are non-refundable.

• A 5% restocking fee is deducted from the refund or store credit.

• If we supply a return label, its cost is deducted once.

These conditions also apply to eligible change-of-mind gift returns. The gift recipient or original purchaser pays the return shipping.

Final-sale restrictions, restocking fees, and change-of-mind shipping deductions do not apply where inconsistent with a remedy required by law, including applicable rights relating to defective, damaged, misdescribed, or incorrectly supplied products.

12. Cancellations & Refunds

Contact us promptly if you wish to cancel an order. Voluntary cancellation may depend on production progress and the conditions disclosed before purchase.

Nothing in these Terms prevents a statutory cancellation. We will process legally required refunds within the applicable legal deadline.

Approved refunds are normally returned to the original payment method. Payment-provider processing time may follow our issuance of the refund.

Gift returns may be issued as store credit as described in our Return and Refund Policy, except where a monetary refund is required by law.

13. Product Use & Care

Use products only for their described purpose and follow supplied care and installation instructions.

Decorative products are not toys or suitable for food contact unless expressly identified for that use.

Outdoor suitability varies by product. Follow the relevant product description and care guidance rather than assuming all wooden products are weatherproof.

To the extent permitted by law, we are not responsible for deterioration or damage caused by misuse, unsuitable exposure, improper care, or unauthorized modification. This does not remove applicable product warranties or statutory rights.

14. Website Use & Intellectual Property

You must not misuse the website, attempt unauthorized access, introduce malicious software, commit fraud, or infringe others’ rights.

Our original website content, photographs, and designs may not be copied or commercially exploited without permission, except as permitted by law.

Third-party trademarks remain the property of their owners.

We may restrict unlawful or abusive website use, without removing obligations we owe under existing purchases.

15. Privacy, Reviews & Third-Party Services

Our collection and handling of personal information are described in our Privacy Policy.

Payment processing and other services may involve Shopify and other providers. We do not guarantee uninterrupted availability of the website or third-party services.

If you submit a review for publication, you permit us to display it and make minor formatting edits that preserve its meaning. We will not knowingly misrepresent your review.

Links to external websites do not make us responsible for their content. This does not remove our responsibility for services we arrange as part of fulfilling your purchase.

16. Warranties & Liability

We remain responsible for express commitments we make and warranties, conditions, and remedies that apply by law.

To the extent permitted by law, we are not liable for indirect or consequential business losses, such as lost profits, arising from website use or a purchase.

This limitation does not exclude liability for fraud, deliberate misconduct, personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded. It does not remove consumer rights or remedies.

17. Governing Law & Disputes

These Terms are governed by the laws of Nova Scotia and the federal laws of Canada applicable there, subject to any mandatory protections available under the laws applicable to the customer.

Contact us first so we can try to resolve a concern. This does not require you to waive legal remedies, mandatory complaint rights, or access to a court or tribunal with jurisdiction.

18. Changes & Order-Specific Agreements

We may update these Terms for future transactions. Changes do not retroactively alter an existing purchase without lawful agreement.

Written order-specific specifications and commitments form part of the purchase agreement. These Terms do not erase representations or rights that remain binding under applicable law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
